The application is an application for Designated Development under the provisions of Clause 45(4)(f) of Schedule 3 of the Environmental Planning and Assessment Regulations 2021 for a Change of use of a shed (A) building and fit out as a plastics recycling facility.
The application is also an application for Integrated Development, and the following approvals are also required:
- Approval from Subsidence Advisory NSW under Clause 22 of the Coal Mine Subsidence Compensation Act 2017
Council’s Community Participation Plan outlines Councils guidelines for notifying applications that are received. The development is on notification from 20 November 2024 to 18 December 2024.

Please note:
Unless the proposed development is development about which the Independent Planning Commission has conducted a public hearing any person:
- who makes a submission by way of objection, and
- who is dissatisfied with the determination of the consent authority to grant development consent,
may appeal to the Land and Environment Court.
If the Independent Planning Commission conducts a public hearing, the Commission’s determination of the application is final and not subject to appeal.
Any submission you make is open to public scrutiny. Council is required to release written comments or submissions under the Government Information (Public Access) Act 2009 (GIPAA). The Act imposes obligations on us to place submissions on Council’s website and submissions may be used in Council reports or court proceedings. In this regard, your comments should be restricted to the proposed development.
Under S10.4 of the EP&A Act, any person making a submission is required to disclose reportable political donations and gifts ($1000 or more) made to any local Councillor or staff member within 2 years of making of the submission. If the application or gift is made after the submission, a disclosure must be made within 7 days of that donation or gift having been made.
